Initial Comments:Based on the findings of an onsite unannounced Medicare recertification survey attempted November 2, 2022, it was determined that Atlantic Home Care, Inc. was found not to be in compliance with the requirements of 42 CFR, Part 484, Subparts B and C, Conditions of Participation: Home Health Agencies.
When the surveyor arrived onsite at agency on November 2, 2022, at approximately 10:00 AM, an interview was conducted with the agency administrator. The interview confirmed that the agency has a zero (0) patient census. "The last time the agency provided skilled services to a patient was in 2020, discharging on 12/11/2020. We have had informal Governing Body meeting and PAC meetings and I am the RN that completes nursing visits if necessary".
For purposes of Medicare participation, a "home health agency" is defined at section 1861(o) of the Social Security Act (Act) to be: "a public agency or private organization...which - (1) is primarily engaged in providing skilled nursing services and other therapeutic services." Atlantic Home Care, Inc. fails to satisfy this essential minimum participation criterion necessary for a home health agency to continue to participate in Medicare as a home health agency.
